Acceptable Use Policy

This Acceptable Use Policy ("AUP") explains the rules for using Smart Transfer ("Smart Transfer", "we", "our", or "us").

Our goal is to provide a fast, secure, and reliable file transfer platform for individuals and businesses. By using Smart Transfer, you agree to comply with this Acceptable Use Policy, our Privacy Policy, and our Terms of Service.

Failure to comply with this policy may result in the suspension or permanent termination of your account, removal of content, or legal action where appropriate.

Malware and Cybercrime

You may not upload or distribute:

  • Viruses

  • Malware

  • Spyware

  • Ransomware

  • Worms

  • Trojans

  • Keyloggers

  • Botnet software

  • Phishing kits

  • Credential harvesting tools

  • Exploit kits

  • Malicious scripts

  • Software intended to compromise computer systems

Intellectual Property Violations

You must not upload or distribute content that infringes the rights of others, including:

  • Copyrighted movies

  • Television shows

  • Music

  • Software

  • Video games

  • Books

  • Images

  • Trademarks

  • Patents

  • Trade secrets

You are responsible for ensuring that you have permission to upload and share any content.

Fraud and Deception

You may not use Smart Transfer for:

  • Phishing

  • Identity theft

  • Financial fraud

  • Investment scams

  • Cryptocurrency scams

  • Romance scams

  • Fake invoices

  • Fake employment offers

  • Social engineering

  • Impersonation

Harmful or Abusive Content

You must not upload content that:

  • Harasses others.

  • Threatens violence.

  • Encourages self-harm.

  • Promotes hate or discrimination.

  • Bullies or intimidates others.

  • Invades another person's privacy.

  • Is defamatory or unlawful.

4. Prohibited Activities

You must not:

  • Attempt to gain unauthorized access to Smart Transfer systems.

  • Probe or test the security of our infrastructure without written permission.

  • Circumvent security measures.

  • Launch denial-of-service (DoS or DDoS) attacks.

  • Use automated systems to overload our platform.

  • Mine cryptocurrency using our infrastructure.

  • Reverse engineer or exploit our software.

  • Upload files solely to consume excessive bandwidth or storage.

  • Interfere with other users' access to the Service.

5. Spam and Unsolicited Communications

Smart Transfer must not be used to:

  • Send spam.

  • Distribute unsolicited marketing.

  • Send chain letters.

  • Conduct mass unsolicited file distribution.

  • Operate phishing campaigns.

  • Distribute malicious email attachments.

6. Privacy and Personal Information

You must not upload or share personal information about another person without a lawful basis or their permission where required by law.

This includes:

  • Identity documents

  • Medical records

  • Financial records

  • Employment records

  • Passwords or login credentials

  • Personal photographs where sharing would violate privacy laws

7. Reporting Abuse

If you become aware of misuse of Smart Transfer, you should report it to us immediately.

8. Enforcement

If we reasonably believe that this Acceptable Use Policy has been violated, we may take one or more of the following actions without prior notice:

  • Remove files.

  • Disable download links.

  • Suspend uploads.

  • Suspend user accounts.

  • Permanently terminate accounts.

  • Restrict access to the Service.

  • Preserve evidence where required by law.

  • Cooperate with law enforcement agencies, regulators, or courts.

  • Disclose information where required or permitted by applicable law.

Our decision regarding enforcement will be based on the nature and severity of the violation and our legal obligations.

9. Cooperation with Law Enforcement

Smart Transfer maintains a zero-tolerance approach to illegal activity.

Where required or permitted by law, we may cooperate with:

  • The South African Police Service (SAPS)

  • The Directorate for Priority Crime Investigation (the Hawks)

  • The Information Regulator

  • South African courts

  • International law enforcement agencies where legally appropriate

  • Other competent regulatory authorities

This may include preserving records, providing information in response to lawful requests, or taking other steps required by law.

10. No Expectation of Illegal Use

Users must not use Smart Transfer with the expectation that the Service can be used to conceal or facilitate unlawful activity.

While we respect user privacy and use security measures such as encrypted connections, nothing in our Services should be interpreted as protecting or assisting illegal conduct.

11. Changes to This Policy

We may update this Acceptable Use Policy from time to time.

The latest version will always be available on the Smart Transfer website.

Your continued use of the Service after changes are published constitutes acceptance of the updated policy.
