Welcome to Smart Transfer ("Smart Transfer", "we", "our", or "us").

These Terms of Service ("Terms") govern your access to and use of the Smart Transfer website and all related services. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use our Services.

1. About Smart Transfer

Smart Transfer provides an online platform that allows users to securely upload, temporarily store, and share digital files with others over the internet.

We may add, modify, suspend, or discontinue features of the Service at any time without prior notice.

2. Eligibility

Abuse APIs or automated systems.

Smart Transfer has a strict zero-tolerance policy for illegal activity.

If we reasonably believe that our Services are being used unlawfully, we may immediately:

Suspend or permanently terminate your account.

Block uploads or downloads.
Preserve relevant records where legally required.

Nothing in these Terms limits our right to take appropriate action to protect our users, our platform, or the public.

6. Ownership of Content

You retain ownership of all files that you upload.

By uploading content to Smart Transfer, you grant us a limited, non-exclusive licence to:

Transmit your files.
Make your files available to recipients you designate.

This licence exists solely to provide the Services and ends when your files are deleted from our systems.

7. Copyright Infringement

You may upload only content that you own or have permission to share.

If we receive a valid complaint that content infringes another person's intellectual property rights, we may:

Remove the content.
Disable access to the files.
Suspend repeat offenders.
Terminate accounts in serious cases.

8. File Availability

Smart Transfer is designed for secure file transfer, not permanent cloud storage.

Files are automatically deleted after the selected storage period expires.

We recommend keeping your own backup copies of all important files.

We do not guarantee that uploaded files will remain available indefinitely.

9. Security

We use reasonable technical and organizational measures to help protect your files and personal information.

These measures include encrypted connections, access controls, and infrastructure security.

However, no internet service is completely secure, and you acknowledge that you use the Service at your own risk.

10. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted availability.

Smart Transfer may occasionally experience interruptions due to:

Maintenance
Software updates
Security incidents
Hardware failures
Network outages
Circumstances beyond our reasonable control

11. Subscription Services

Where paid plans are offered:

Fees are charged according to the selected plan.
Subscription fees are payable in advance.
Failure to pay may result in suspension or cancellation of Services.
Prices may change with reasonable notice.

Unless otherwise stated, subscriptions automatically renew until cancelled.

12. Refunds

Refunds, where applicable, will be considered in accordance with South African consumer protection laws and our refund policy.

Unused subscription periods may not be refundable unless required by law.

13. Disclaimer

Smart Transfer provides its Services on an "as is" and "as available" basis.

To the fullest extent permitted by law, we make no warranties regarding:

Freedom from interruptions.

14. Limitation of Liability

To the fullest extent permitted by law, Smart Transfer, its owners, employees, contractors, and affiliates shall not be liable for:

Corrupted files.
Lost profits.
Business interruption.
Indirect or consequential damages.
Files sent to incorrect recipients.
Unauthorized access resulting from compromised user credentials.
Delays caused by third-party infrastructure providers.

Our total liability for any claim arising from your use of the Services shall not exceed the amount you paid to Smart Transfer during the twelve (12) months preceding the event giving rise to the claim.

15. Indemnity

You agree to indemnify and hold harmless Smart Transfer, its owners, employees, contractors, affiliates, and partners from any claims, losses, damages, liabilities, costs, or expenses arising from:

Your use of the Services.
Your uploaded content.
Your violation of these Terms.
Your infringement of another person's rights.
Your unlawful conduct.

16. Suspension and Termination

We may suspend or terminate your account without prior notice if:

You violate these Terms.
You engage in illegal activity.
Your actions pose a security risk.
You abuse the Services.
You interfere with other users or our systems.

Termination does not limit our right to pursue legal remedies where appropriate.

These Terms are governed by the laws of the Republic of South Africa.
